You have absolutely nothing to worry about. This debt is WAY outside the statute of limitations for all 50 states…it is also past the allowable 7-year reporting cycle on credit reports….so they can't place this on your credit file . This is ancient, time barred debt….because of this, the collection agency is powerless over you….other than trying to scare/annoy you into paying.
Send the collection agency a letter via Certified Mail + Return Receipt stating:
Per the Fair Debt Collection Practices Act, I am requesting:
- written validation of this alleged debt and that said alleged debt is within the statute of limitations
- Cease all verbal communications with me about this alleged debt.

SSI – SSDI cannot be garnished….Wages in Texas cannot be garnished. It would be pointless of them to pursue legal action against you under these circumstances….that is, unless you have a lot of money in a bank account….Otherwise, even if they do win and get a judgment, they can't touch your SSI – SSDI.
DO NOT sign anything that any third-party or the debt collectors send you.
If you have little or no money in the bank and SSI is your only source of money….you can't be touched.
Debt collectors LOVE to scare people with bogus threats of lawsuits….This is illegal. If you are REALLY being taken to court….you will be served papers (usually by a sheriff or other official). Simply giving you a civil suit # doesn't mean anything and debt collectors have NO legal authority to summon you to court. Debt collectors absolutely, positively do not have the ability to initiate court hearings by themselves….only the judge/civil court has such power.
Debt collectors cannot be abusive and they cannot pretend to be (or work for) attorneys when this is not the case. The next time the debt collector threatens legal action or quotes a "civil suit #," per the Fair Debt Collection Practices Act, you have the right to speak with their [alleged] attorney who will be taking action against you. Request to know the attorney's full name and his/her license # in the Texas state bar association.

The general rule is to pay off those with the smallest balance first. Then you take the monthly payment you were used to paying on those, and add it to the minimum payment due on the next bill. In the meantime, you would pay the minimum due on all the other cards except for the one you are working on paying off.
It does seem overwhelming sometimes, but if you keep at it, you will be out of debt. We have been working at this ourselves, and we finally see an end in sight. I recommend reading "How to Save Money Everyday" by Ellie Kay. It helped us tremendously.
I would also shop around for a consolication loan. If you don't get approved at first, keep trying.

Good question! This does need to be taught in schools because the day I graduated high school I realized I had book knowledge to show for all my hard work but I didn't know how to navigate thru life. Health insurance, job interviews, car insurance, a banking account, taxes…..all greek to me. Heck I'm 30 and I still can't figure out my 401k plan. I learned thru trial and error and paying late fees. I got garnished a few times and got some utilities cut off and realized you have to stay on top of it or it bites ya in the behind. And the long arm of the law….they don't forget about fines.

This sounds similar to the medical savings accounts. The problem is, even though those plans were written into law and are available, nobody knows about them! It's just too complicated, you have to start worrying about people who can't afford it, what happens when the market crashes, etc. Maybe you could get it to work, but today's Republican Party is so bankrupt that they haven't put forth any serious proposals, and they're the ones you would think it would appeal to philosophically.

I'm no expert, but can you have a power of attorney drawn up so that you can talk with these creditors on her behalf? I would imagine that if you could obtain a power of attorney, they would be more willing to talk to you and perhaps work something out with you both. I have had some issues with creditors and they are generally pretty open to working out a deal if you are willing to work with them. It's worth a shot! Otherwise, the creditors will continue to call unless your relative submits a letter to them requesting that they only contact her via mail and indicate to them that the phone contact will be considered harassment if it does not stop.
